It does if you are in combat and doesn't if you are not.

To be exact: dirt kick lags you for round is you on civil terrain and cannot find dirt, but have target. So no combat initiated but you still stand round like an idiot :-)

But ave no complains. Instakills is a nice thing and shouldn't be fixed ( bad example - assasinate)
