i was in the forest for a while trying to figure out why. I came to the conclusion that it only happened after the mob was blind and than the disarm attempts. other than that I dunno.

I think it has something to do with archery+ambush bug... perhaps the code treats the next blow after the disarm attempt as ambush opportunity...

If I were you, I'd create trash char (fighter/ass), advance him some levels and test it with him.
I am not sure your immortal char is legit for such kind of testing.
